Can your employer cancel your casual shift in Australia?

As a casual worker in Australia, your shifts can be cancelled, but your employer must follow specific rules. Here is what the law says and what you are entitled to.

Most working holiday makers in Australia work as casual employees. Casual work offers flexibility for both worker and employer, but it also comes with specific rules around shift cancellations and minimum pay. Knowing these rules means you are less likely to lose income unnecessarily.

Can a casual shift be cancelled?

Yes, but not without consequences. Under Australian workplace law, if an employer cancels a casual shift, they should give the employee reasonable notice. If a shift is cancelled with less than 24 hours notice and you had already made arrangements to attend, you are generally entitled to payment for a minimum number of hours.

What is the minimum shift payment?

In most industries covered by a Modern Award, the minimum engagement for a casual employee is two to three hours. This means that if you arrive at work and your employer sends you home immediately, or if your shift is cancelled with very short notice, you are generally entitled to payment for those minimum hours regardless.

What if you are sent home early?

If you are mid-shift and your employer asks you to leave early, the same minimum engagement rules apply. Unless you have already worked more than the minimum number of hours, your employer must pay you up to that minimum.

Are you entitled to sick pay if you cannot come in?

No. Casual employees in Australia are not entitled to paid sick leave. You receive a higher hourly rate than permanent employees โ€” the casual loading โ€” which compensates for the absence of leave entitlements. If you cannot attend a shift due to illness, you are not paid for that shift.

No minimum number of shifts per week

Your employer is not required to guarantee you a certain number of shifts each week. Casual employment means you work when the business needs you. If shifts dry up, there is generally no legal remedy unless you can demonstrate you have become a de facto regular employee over a long period.

Practical steps if your shifts are being cancelled

Keep a record of your roster, any communications about shift changes, and the notice period given. If you are not receiving your minimum engagement payment after a short-notice cancellation, raise it directly with your employer. If that does not resolve it, you can lodge a complaint with Fair Work Australia at no cost.
